    The Temporary Skill Shortage (TSS) Visa is the name of the visa which (as of today) replaces the now defunct Australian 457 Visa.

    As we announced yesterday, the Turnball government has chosen to axe the old 457 Visa scheme citing abuse of the scheme by Australian businesses. Ultimately, the view from the Australian Government is that overseas workers were getting jobs and local workers were being overlooked.. allegedly.

    Now 24 hours has passed and we’ve all had a little chance to calm down. We thought we’d provide a little more information on the TSS and provide a little insight into how this might affect workers looking to migrate to Australia under the Temporary Skill Shortage Visa scheme.

    TSS Visa – How the Temporary Skill Shortage Visa Works

    So in short, the new TSS Visa scheme will be made up of two streams, one short term (issued for two years) and one medium-term (issued for up to four years for “more focused occupation lists”).

    Both of these will be subject to labour market testing including a requirement for two years of work experience, a market salary rate assessment and a new non-discriminatory workforce test.

    The number of eligible occupations for the new types of visas will be shortened by 216, with 268 available for the two-year visa and 167 for the longer four-year visa.

    Applicants will also now have to meet English language requirements and undergo a criminal check.
    The changes are in effect immediately and will be fully implemented by 2018.

    What Occupations will qualify for a TSS Visa

    Historically, to qualify for a 457 Visa, your occupation had to appear on what used to be referred to as the Consolidated Sponsored Occupations List or CSOL. As part of the

    What Occupations Are Likely To Be Impacted The Most Under The New TSS Visa Scheme?

    Well, to begin with, over 200 jobs have been removed which means that unfortunately, a number of occupations will be impacted.

    Based on the historical 457 Visa numbers, theoretically, the industries that stand to be most affected are information technology (the largest sponsor), followed by the professional, scientific and technical services, accommodation and food services. However, the top three occupations under 457 visas contributed fewer than 15% of all visa grants in 2015-16.

    However, the top three occupations under 457 visas contributed fewer than 15% of all visa grants in 2015-16 and at time of typing, it’s difficult to fully appreciate how the introduction of the TSS Visa scheme will influence Australian business hiring habits.

    TSS Visa and Australian Permanent Residency (PR)

    It’s fair to say that one of the biggest attractions of the 457 Visa scheme was the opportunity it gave 457 visa holders to gain Australian Permanent Residency (PR) after two years.

    Many people on 457 visas ended up gaining a permanent visa, with many of these applicants being sponsored for PR by their employer.

    In the 2015-16 migration year, for example, a total of 51,110 people on a 457 visa were granted a permanent visa.

    Under the TSS Visa scheme, this will change. The Australian government has already indicated that Australian permanent residency will not be made available to applicants on the short-term (two years) stream, though we have still to receive confirmation if Australian PR may be an option for those moving to Australia under the 4-year option.

    It is also unclear what the 457 changes will mean for the transition from temporary to permanent residency although existing visa holders will be grandfathered under the old system, providing a level of certainty at least in the short-term.

    Occupations on the Short-term Skilled Occupation List (STSOL)

    From 19 April 2017, the CSOL list has received a name change and will now be referred to as the STSOL (Short-term skilled occupation list).

    This list is current as of 19 April 2017 and is expected to be updated every six months. If you are applying for a Temporary Skill Shortage Visa (TSS Visa) your occupation will need to appear in this list.

    Note 2.    nec means “not elsewhere classified”.

    Note 3.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions in a limited service restaurant.  A limited service restaurant includes, but is not limited to, any of the following:

    1. a) fast food or takeaway food services;
    2. b) fast casual restaurants;
    3. c) drinking establishments that offer only a limited food service;
    4. d) limited service cafes including, but not limited to, coffee shops or mall cafes;
    5. e) limited service pizza restaurants.

    Note 4.    Minister of Religion is specified as a skilled occupation only for the purposes of paragraph 2.72B(3)(b) of the Regulations, and only in relation to an application for a Subclass 407 (Training) visa. Minister of Religion is not specified as a skilled occupation in relation to any other visa subclass, despite paragraphs 2, 5, 6 and 8.

    Note 5.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) clerical, book keeper and accounting clerk positions;
    2. b) positions in a business that have an annual turnover of less than
      AUD 1 million;
    3. c) positions in a business that have fewer than five employees.

    Note 6.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related  to animal husbandry including, but not limited to, caring for livestock on a farm setting.

    Note 7.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related to mass or standardised production, including positions based in a franchise or factory, as opposed to specialist production. Positions excluded, but not limited to the following exclusions, are any of the following:

    1. a) positions that involve full or partial production of food product for distribution to another location;
    2. b) positions that predominantly involve the use of pre-prepared food product from another location.

    Note 8.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions that are not located in a commercial building or shopping centre environment;
    2. b) positions that predominately involve the management of the provision of only one particular service to a facility or managing one particular relationship.

    Example:    a position that manages the cleaning contract for a facility but not other contracts relevant to the facility.

    Note 9.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions in a business that have an annual turnover of less than AUD 1 million;
    2. b) positions that have a nominated base salary of less than AUD 65,000.

     

     

    Note 10: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions based in a front-line retail setting;
    2. b) positions that predominately involve direct client transactional interaction on a regular basis;
    3. c) positions in a business that have an annual turnover of less than AUD 1 million;
    4. d) positions that have a nominated base salary of less than AUD 65,000.

    Note 11.  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions involved in mass production in a factory setting and positions in a limited service restaurant.  A limited service restaurant includes, but is not limited to, any of the following:

    1. a) fast food or takeaway food services;
    2. b) fast casual restaurants;
    3. c) drinking establishments that offer only a limited food service;
    4. d) limited service cafes including, but not limited to, coffee shops or mall cafes;
    5. e) limited service pizza restaurants.

    Note 12.  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominantly involve low-skilled tasks.

    Examples:    fruit picking or packing, feeding of livestock or animals

    Note 13:  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions that predominately involve hair dressing and/or beauty therapy related non-managerial tasks; or
    2. b) positions in a business that employ fewer than five employees.

    1. a) truck driver positions;
    2. b) fleet manager positions;
    3. c) container controller positions;
    4. d) positions in a business that have an annual turnover of less than AUD 1 million;
    5. e) positions in a business that have fewer than five employees.

    Note 17:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any one of the following:

    1. a) positions in a business that have an annual turnover of less than AUD 1 million;
    2. b) positions in a business that have fewer than five employees;
    3. c) positions that have a nominated base salary of less than AUD 90,000.

    Note 18:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any one of the following:

    1. a) positions in a business that have an annual turnover of less than AUD 1 million;
    2. b) positions in a business that have fewer than five employees;
    3. c) positions that have a nominated base salary of less than AUD 80,000.

    Note 19:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominately involve  responsibility for managing hotel or motel staff.  The specification does not exclude positions that predominately involve responsibility for organising and controlling the operations of a hotel or motel that may have limited duties requiring management of hotel or motel staff but is not the main function of the position.

    Note 20:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that do not require a minimum of two years relevant work experience.

    Note 21:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions in a business that have an annual turnover of less than AUD 1 million;
    2. b) positions in a business that have fewer than five employees.

    Note 22:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions relating to mobile phone repairs.

    Note 23:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions in a business with an annual turnover of less than AUD 1 million;
    2. b) positions in a business with fewer than five employees;
    3. c) positions that have a nominated base salary of less than AUD 65,000.

    Note 24:   In relation to specifications of occupations for Subclass 186 – Employer Nomination Scheme visa, for the purposes of sub-subparagraph 5.19(4)(h)(i)(A) of the Regulations, indicates that, despite paragraph 6, for an application for approval of a nomination for a Subclass 186 visa, the occupation excludes positions in Fast Food or Takeaway Food Service.

    Note 25:    These occupations are specified as a skilled occupation only in relation to an application for a visa listed below. These occupations are not specified as a skilled occupation in relation to any other visa subclass, despite paragraphs 2, 5, 6 and 8.

    MLTSSL – Medium and Long-term Strategic Skills List

    MLTSSL -Medium and Long-term Strategic Skills List

    The MTSSL or the Medium and Long-Term Strategic Skills List is a list, published by the Australian government, of occupations that qualify for consideration as part of an Applicants Australian Visa Application.

    The list used to be referred to as the Australian Skilled Occupations List (SOL) but for whatever reason (perhaps there weren’t enough acronyms) the Australian government made the decision to present the updated list which they called the MLTSSL,

    If you are looking to emigrate to Australia under one of the skilled Visa Schemes, you will need to have an occupation posted on the MLTSSL.

    Occupations on the MLTSSL

    Occupations that appear on the Medium and Long-term Strategic Skills List (MLTSSL) are listed below in alphabetical order for ease of reference. It’s not the easiest of lists to follow so please take note of the comments at the beginning of the list that explain the purpose of some of the asterixis and other notes.

    Please Note:

    • Caveats apply to certain occupations on these lists which exclude the use of the occupation in certain circumstances for the Temporary Work (Skilled) visa (Subclass 457) programme.
      Caveats are indicated via ‘*** asterisks’. For specific information about each caveat – see the legislative Instrument page on the Australian Governments website.
    • Certain occupations on the MLTSSL are flagged with a double Asterix which means that these occupation types are restricted to applicants applying under certain visa classes only. The occupations indicated via ‘** asterisks’ are only available for the following visa programs
      • Skilled – Independent (subclass 189)
      • Temporary Graduate (subclass 485)
      • Skilled-Regional (Provisional) (subclass 489), if the applicant is not nominated by a State or Territory government agency.

    • Applicants who require a skills assessment as part of their visa application must contact a relevant assessing authority directly to obtain a skill assessment.     2017 - 2018 Australian Skilled Occupations List (SOL)

    The 2017 – 2018 Australian Skilled Occupations List (SOL) has been published with approximately 200 occupations being removed from what was the 2016 – 2017 SOL

    The updated list is available below, in addition, to the 200 roles being removed the SOL has also had a name change with the list now being referred to as (its a mouthful!) the Medium and Long-term Strategic Skills List (MLTSSL). See here for the list of jobs removed from the previous 2016 – 2017 SOL.

    From 19 April 2017, the CSOL list has also received a name change and will now be referred to as STSOL (Short-term skilled occupation list)

    Note 3.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions in a limited service restaurant.  A limited service restaurant includes, but is not limited to, any of the following:

    1. a) fast food or takeaway food services;
    2. b) fast casual restaurants;
    3. c) drinking establishments that offer only a limited food service;

    Note 7.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related to mass or standardised production, including positions based in a franchise or factory, as opposed to specialist production. Positions excluded, but not limited to the following exclusions, are any of the following:

    1. a) positions that involve full or partial production of food product for distribution to another location;
    2. b) positions that predominantly involve the use of pre-prepared food product from another location.

    Note 8.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

    1. a) positions that are not located in a commercial building or shopping centre environment;
    2. b) positions that predominately involve the management of the provision of only one particular service to a facility or managing one particular relationship.

    457 Visa To Be Abolished – Replaced With New TSS Visa

    Today, (18 April 2017), the Australian Government announced that the Temporary Work (Skilled) visa (subclass 457 visa) will be abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa in March 2018.

    Introducing the TSS Visa Program

    The TSS visa programme will be comprised of a Short-Term stream of up to two years and a Medium-Term stream of up to four years.

    This new visa is part of the Government’s reform package to strengthen the integrity and quality of Australia’s temporary and permanent employer-sponsored skilled migration programmes.

    The 457 visa is the most commonly used program for Australian or overseas employers to sponsor skilled overseas workers to work in Australia temporarily. The 457 visa provided 2 main alternatives, Business sponsorship and self-sponsorship.

    See the Announcement posted bu the Australian PM Below. In it, Mr Turnbull says that the four-year visa system, which permits highly skilled migrants to apply for permanent residency at its conclusion, would be replaced in a bid to protect Australian jobs.

    The 95,000 skilled migrants currently in Australia on 457 visas would be unaffected and still be able apply for permanent residency at the end of the four years.

    “We will no longer allow 457 visas to be passports to jobs that could and should go to Australians,” Mr Turnbull said

    What we currently know:

    When is the 457 visa programme going to be removed?

    No actual date has been announced yet for the changes to take place. However, it is expected to be soon. The announcement on the Australian migration government website states “The implementation of these reforms will begin immediately and will be completed in March 2018”.

    I am currently on a 457 visa! What will happen to my status?

    At this time we understand that all existing 457 visa holders will maintain their visa status and permanent residency can still be applied for at the end of this period.

    Immigration Minister Peter Dutton said the 95,000 people already in the country on a 457 work permit would be unaffected by the change and permitted to apply for residency.

    Beyond that, no further 457 visas will be issued.

    Unlike the current visa arrangement, the replacement — a two year temporary visa specifically designed to recruit the “best and the brightest” in the national interest — will not allow permanent residency at its conclusion.

    Occupation Groups Nearing Their Occupation Ceilings

    Australian Occupations SOL Reaching Ceiling

    An occupation ceiling is a limit on the number of invitations that can be issued through SkillSelect each year. They are based on a percentage of stock employment figures for each occupation.

    Stock employment figures are provided by the Australian Bureau of Statistics, and represent the number of people employed in Australia in each occupation.

    The ceilings ensure the skilled migration programme is not dominated by a narrow group of occupations and is applied to the following Australian Visa Classes.

    • Skilled independent visas
    • Skilled regional sponsored visas
    • Skilled or business state or territory sponsored visas.

    Earlier today, we flagged that the Occupations Ceiling had been reached For Engineering and Computer Related Roles. This means that those applicants looking to emigrate to Australia under these professions will NOT receive an invitation to apply within the current Australian Migration Year which runs through to 30 June 2016.

    After this point, your occupation will need to appear on the soon to be published 2017 – 2018 Skilled Occupation List (SOL) to qualify for an Australian skill based Visa.

    At the time of typing (18th April 2017), there are many other occupation groups which are reaching the occupations ceilings. The following groups may be reaching their ceilings in the next rounds of invitations:

    If you’re looking to apply for an Australia Skilled based visa under any of these occupations the number of invitations remaining are limited so you might need to wait until the 2017 – 2018 migration year before you receive an invitation to apply.

    Occupations Ceiling Reached For Engineering and Computer Related Roles

    Each year, the Australian Government sets occupation ceilings for each occupation class meaning that if a job appears on the Skilled Occupations list for that year, you qualify to apply for an Australian Visa, but only until the number allocated for each occupation type has been fully utilised.

    This ensures that there is a reasonable balance of different skill sets being represented across the group of migrants seeking residency within Australia.

    As of 31 March 2017, two groups of occupations have met their respective occupation ceilings and will no longer receive further invitations for this programme year. The two groups of occupations are:

    • Other Engineering Professionals (ANZSCO Group 2339)Computer Network Professional (ANZSCO Group 2631)
    • Computer Network Professional (ANZSCO Group 2631)

    If your nominated occupation is from one of the the ANZSCO Groups above, you will not receive an invitation to apply, until the invitation rounds from 1 July 2017 onwards. We say this with the caveat that the role types appear in the 2017 – 2018 SOL, Engineering Jobs, in particular, are under the spotlight for next year.

    The occupation ceilings apply to the subclass 189 Skilled Independent Visa and subclass 489 Skilled Regional Sponsored Visa (Relative) categories. State or Territory Nominated visas (subclass 190 and 489), Employer Sponsored (subclass 457, ENS 186 and RSMS 187) or Business Innovation and Investment visa subclasses are not subject to the occupation ceilings.

    Queensland State Government Suspends Skilled Visa Nominations

    As we begin to venture closer to the end of the current migration intake year (1st July 2016 – 30 June 2017), Australian states are starting to see their allocation ceilings for certain visa types being filled.

    Yesterday, Business and Skilled Migration Queensland (BSMQ) announced that they have temporarily suspended the acceptance of all applications for Queensland Skilled Visa Nominations under the State Nominated scheme Subclass 190 & 489, due to having reached their DIBP allocated ceiling.

    If you currently have a paid application with BSMQ that has not been finalised, you can either choose to:

    stay in the queue to be processed once applications have been reopened OR
    request a refund and your application will be withdrawn.

    If you have submitted an EOI with Skillselect that has not been considered, your EOI is no longer valid and you will be required to resubmit an EOI once the application process has been reopened.

    Please note that there may be changes made to the Queensland Skilled Occupation list and only EOIs meeting new criteria will be considered.
